These Terms and Conditions (“Terms”) govern your use of our (“I/We/Us/Our)” website, idealhypnotherapy.com (“Website”), and any services, resources, or content offered through this website.

Please read these Terms carefully as they relate to our website. By accessing or using any part of the website, you agree to be bound by these Terms. If you disagree, you must refrain from accessing or using this website.

1. Scope of Services

Ideal Hypnotherapy’s website provides hypnotherapy sessions, educational content, informational articles, and related resources. The information provided is intended for general informational purposes and is not a substitute for professional medical advice, diagnosis, or treatment.

This website is accessible worldwide and is in British-English in audio and text, note. I do not provide translations; if you use translation apps or other tools, that is up to you, but I am not liable for their accuracy or effectiveness, of course, so please ensure accuracy yourself.

Service Availability and Jurisdiction:
As a sole practitioner operating an online hypnotherapy business, I reserve the right to determine the countries and regions in which I offer my services. This decision is based on various factors, including but not limited to legal and licensing requirements, data protection regulations, language compatibility, and the practicalities of delivering effective and ethical care across different jurisdictions. By limiting service availability, I aim to ensure that all clients receive safe, lawful, and suitably supported therapeutic services. I do not offer services in jurisdictions where I am not authorised to practise or where local regulations might conflict with the standards of professional conduct I uphold.

The current scope of my online hypnotherapy services includes the United Kingdom and Northern Ireland, as well as most parts of Europe, Australia and New Zealand, where a good standard of English fluency is expected. Additionally, I am limited by the constraints of my professional indemnity insurance, which prevents me from offering services in other regions, including the US, Canada, and their territories.

Important: Hypnotherapy is complementary and should not be used as a substitute for conventional medical or psychological treatment. If you are experiencing a medical or mental health crisis, please contact your GP/ Healthcare professional immediately.

2. Eligibility

To use our website or book sessions through my platform, you must be at least 18 (the age of legal majority in the UK). Using this website, you represent and warrant meeting this eligibility requirement.

If you are accessing hypnotherapy services on behalf of a minor, additional consent and authorisation forms will be required before treatment.

Under 16 Years Old: It is generally advised that a parent or guardian accompany children under the age of 16 during hypnotherapy sessions. This practice ensures the child’s safety, facilitates informed consent, and aligns with safeguarding protocols.

Ages 16 and 17: Individuals aged 16 and 17 are typically considered capable of consenting to their treatment. However, therapists may still choose to involve a parent or guardian, depending on the client’s maturity and the nature of the therapy. It’s essential to note that child protection legislation remains in effect until the individual turns 18 and that records are kept securely till the child becomes 25 years of age.

Being accompanied is assessed on whether Gillick Competence can be demonstrated. ‘Gillick competence’ refers to a legal standard in the UK that determines whether a child under 16 has the maturity and understanding to make decisions about their medical treatment without requiring parental or other caregivers’ consent.

3. Client Responsibility and Disclaimers

While hypnotherapy can promote personal change and growth, outcomes vary by individual and cannot be guaranteed. By engaging with our services, you acknowledge and agree that:

• You are responsible for your health, decisions, and outcomes.
• Hypnotherapy is not a cure for medical or psychological disorders.
• Any changes you experience during or after sessions are personal and subjective.
• You must disclose any relevant medical conditions or psychiatric diagnoses before commencing therapy.

I make no representations or warranties regarding specific results you may experience.

4. Booking and Payment Terms

Appointments can be scheduled through our website, email, or by phone. Full payment is normally due at the time of booking, before a session (or in advance of, for packages), unless otherwise agreed in writing.

Appointment Cancellation Policy:

• Cancellations must be made at least 24 hours before your scheduled appointment.
• No-shows are charged the full session fee.
• A client may change the date of sessions with up to 24 hours’ notice.
• Cancellations with less than 24 hours’ notice will result in the client liable for the missed session’s cost.
• Fees paid are non-refundable after any session or course of treatment.

We reserve the right to reschedule appointments due to unforeseen circumstances, with appropriate notice.

5. Refund Policy

Refunds for unused prepaid sessions may be considered on a case-by-case basis. No refunds are provided for completed sessions. Digital products, downloads, and online courses are non-refundable once accessed.

Refunds beyond 24 hours are set at 97% of the total paid by you at booking, as Stripe deducts 3% during booking and does not reimburse me this upon cancellation of your appointment. Kindly note. 

6. Intellectual Property Rights

All content on this website—including text, graphics, logos, images, videos, audio clips, downloads, and software—is the property of Ideal Hypnotherapy or its content suppliers and is protected by copyright, registered trademark (IPO), and other applicable intellectual property laws.

Using the name Ideal Hypnotherapy, and/or the logo and strapline (Making Change Happen), as part/whole of your own business is strictly forbidden. All of these are protected by copyright and registered trademarks (IPO) under Kailash (“Kail”) Shanker. Intellectual Property rights protect them.

IMPORTANT – PLEASE NOTE:

Attaching labels to ‘Ideal xxx Hypnosis and Hypnotherapy’ (as your own trademark or business name) could breach trademark and copyright laws, please note.

I will seek legal advice to address any serious violations or copyright infringements of my trademark, logo image, brand colours, strapline, and branding (including the copying of text and images contained therein), which may necessitate recourse through the courts. These are all fully TM licensed to me through the IPO.

You may not copy, reproduce, republish, upload, post, transmit, or distribute any material from this website without my prior written permission.

7. Privacy and Confidentiality

We are committed to protecting your privacy and maintaining the confidentiality of client information in accordance with applicable privacy laws and professional ethical standards.

8. User Conduct

You totally agree not to:

• Refer to the website to justify or represent your views, if maliciously applied.

I reserve the right to terminate your access to the website if you violate these Terms.

All services are provided “as is” and “as available” without any warranties of any kind, either express or implied.

The views, ideas and opinions expressed in this website and related documents are presented in good faith, based on the state of the industry today (present knowledge), and the education, training and understanding of me, Kail Shanker. There is no conscious or ill intention to manipulate, defraud, or dishonestly upsell services; all views are honestly given to help clients fairly, legally, and in good faith. No liabilities shall arise through any unintended interpretations or effects herein.

11. Modifications to Terms

We reserve the right to modify these Terms at any time, effective upon posting the updated Terms on the Website. Continued use of the Website after such changes constitutes your acceptance of the revised Terms.

It is your responsibility to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed by the laws of the United Kingdom (and also Europe, if applicable), without regard to its conflict of law principles.

Ideal Hypnotherapy is protected by UK and International Laws, and all applicable online protections.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in the UK and not abroad.
